POLICE will seize the private car of a man allegedly caught driving a car dealership vehicle without a licence in the first case of a substitute vehicle being surrendered under new seizure laws.
The 22-year-old man was working for a northern suburbs car dealer when he was allegedly caught driving without a licence on Berriman Dr in Wangara last night.

The car, which belongs to a 39-year-old woman, was seized by police.

Under new laws, overhauled on September 1, police issued a ‘surrender substitute vehicle notice’ after a hardship application was submitted by the woman.

In the past, flawed hoon legislation left a high-profile doctor without his Lamborghini for 28 days when a mechanic was caught speeding during a test drive.

In a separate incident in February, a car dealership also paid the price for the actions of a test driver caught speeding in a $45,000 Mini Cooper S.
Police today released the woman's car and the 22-year-old man has until September 16 to surrender his personal vehicle.

The man will be charged with no authority to drive and will appear in court at a later date.

Watch the out cry when mr big business man gets his merc conficasted and all his cars are under a company name and he pleads hardship for the business and he doesnt get anything confiscated.

Or company cars that people drive and nothing to replace it with.

It's all well and good saying that, but its not entirely uncommon for people to be hoon lawed these days when they didn't actually do anything wrong.

The laws need major overhauling anyway.
It has given the police godly powers of witness, police, judge and jury with no 3rd party intervention whatsoever and even contesting it in court is futile due to it being ni on impossible of providing proof of innocence.
Im all for if you fuck up wear the penalty but for having your personal property taken off you that should be for a magistrate to do and the police to provide sufficient evidence of a law being broken.

These days it can just be some senile old crunt who is generally pissed off reporting your license plates for *hooning* even if you're not breaking the law, all it takes is a performance car that gets a little attention and possibly a loud exhaust.

I've seen friend's cars confiscated just by word of witness, no proof or cops.

These hoon laws are a joke.

Just put a video camera in your car and record EVERYTHING you do. Then you have "evidence" to the contrary if a bullshit claim is made...? Profit if some unwitting bird gets involved and your "home video" ends up on bangbus or the similar.
