first "import" to be crushed ?
Because auctioning off would be sensible and we dont do sensible in WA. It would be followed by some bullshit excuse like the police giving someone else the opportunity to hoon in it again. blah blah blah

Deserve it ? Material goods (like cars) are purchased not deserved...if the bloke could fork out the dough to run such a machine I feel that he can no worries.
A license on the other hand is a privileged earned not a right obtained. I don't think that material possessions should be taken away from you and destroyed because you fucked up just take away the privilege to put foot to pedal for life.
Since the introduction of the "no hat no play" style license law has passed I personally haven't sat behind the wheel as I am scared shitless of getting my car impounded (/CSB) but I can see that people would take chances, be fuckheads and take to the roads without one.
Rant is a bit off topic but I am just frustrated knowing that cops can take what really is your hard earned money...and burn it.

If the owner did something wrong, why punish the car?
Gents, we need to remove ourselves from the emotional attachment we have with our cars and other nice performance cars with this issue.
The owners of these cars being crushed all know the risks associated with wreckless driving, speeding or whatever resulting in enough penalties to have their car crushed. There are plenty of warnings out there. Sure many will disagree with my comments and say that the car is not at fault, but it certainly teaches the owner a very big lesson.

the crushing is media hyperbole.

If anything auction for charity should be the go, kinda like assets seized under drug laws

Think if i offer to "donate" $15k to a certain member of the police, they'd see fit to "reward" me with said Evo IX? old school QLD cop spec.
of course, $15k worth of hookers and drugs would be more historically accurate.
pretty devo seeing a car like this getting crushed. no doubt the owner fucked up pretty severe, and deserves to be punished...

i am bored and decided to look at the road traffic act....after sifting through alot of crap....it appears that the commissioner can sell or dispose of a car if they choose.
(2) The Commissioner may sell or otherwise dispose of a
confiscated vehicle, an uncollected vehicle or an item.
(3) The Commissioner is not to sell or otherwise dispose of a
confiscated vehicle, an uncollected vehicle or an item unless —
(a) any appeal against the conviction for an offence in
respect of which the vehicle was impounded or
confiscated is determined; and
(b) any appeal against an impounding or confiscation order
in respect of the vehicle is determined.
(4) The Commissioner is not to sell or otherwise dispose of an
uncollected vehicle or an item unless —
(a) each responsible person is given at least 14 days’ written
notice of the Commissioner’s intention to sell or dispose
of the vehicle or item; and
(b) a notice of the intention to sell or dispose of the vehicle
or item is published, at least 14 days before the proposed
sale or disposal, in a newspaper having State-wide
circulation; and
(c) in the case of an item, reasonable steps have been taken
to return the item to its owner; and
(d) any proceedings under subsection (5) or (6) in relation to
the vehicle or item and any appeal in respect of those
proceedings are determined.

So it may not get crushed basically?
sprint347
10-09-2010, 11:42 AM
If they sell the vehicle there's a good chance the car will end up back in the hands of the offender. I think the image of watching your pride and joy being crushed is the message they're trying to send out to people, rather than have their mate go to the auction and buy the car back.
I am by no means supportive of these laws, in fact I think it encourages people to run from the cops and endanger more lives. But at some point we have to consider the reasons why these laws exist.
Too many young people are wiping themselves (and others) out by driving beyond their abilities, the location and the conditions. Cars are only getting faster and faster and parents are being less responsible and letting kids get 600hp cars.
I don't know what the solution is, in fact I don't really think there is one. But the tools out there are making it hard for enthusiasts as much as the police are, who are reacting to public pressure.
I'm no angel, in fact I'm pretty lucky to get away with some of the shit I've done. But 7 years ago a 200kw V8 was quick, you get that in a taxi these days... literally.

10-09-2010, 11:45 AM
So it may not get crushed basically?
not really, its up to the commissioner to decide.
they can sell the vehicle, but they can dispose of the vehicle too
it takes a bit to get to this stage...the owner would have had multiple times of impounding and been caught reckless driving
if they do sell the car, they first take out court fees, impounding fees etc, and then the balance gets divided up to the Road Trauma trust account (state gov basically)
If they sell the vehicle there's a good chance the car will end up back in the hands of the offender. I think the image of watching your pride and joy being crushed is the message they're trying to send out to people, rather than have their mate go to the auction and buy the car back.
What's stopping the offender going out and buying another Evo 9? Your logic is flawed. Should be sold and money used for a good cause.
Regardless of what gets done to the car, he has lost it, which is the lesson he should learn from

That is all fair and good, but what they should be focusing on is driver education and training. We have the environment to allow it, but nothing is being done about it, and the system remains flawed.

I'm talking about the specific car, of which the owner has as sentimental attachment to, being completely eliminated. They're going for shock value.

But we have to at least admit that there is an issue.
The fact AL have started up the Motorsports side of things I believe is socially responsible and good for the future of AL.

from all the money they have spent chasing etc this car they could at least send it to auction to recoup some of the running costs caused by this car getting hoon lawed.

It also makes the punishment unfair due to someone having a 1000 dollar pos compared to someone in a ferrari, so basically everyone should just buy shit cars if they want to fuck around in the street.....
There should be set fines as always and loss of license, none of this crushing bs...
Also does anyone know if motorbikes can be hoonlawed, I'm guessing they can just not 100%.

They are always complaining of not having enough money to put cops on the street, this is a 40k car being crushed, thats like lighting a fire on 40k cash, thats a junior officer (or close to).

What I do not understand is how can the state government take your car?
Hypothetical situation:
Man has a 3 piece feed.. which he paid for with money he legitimately works for.. The man is caught not dipping chips in the potato and gravy on one occasion, then in a separate incident does not eat the skin and after further investigation he got a 7up with it and that shit is just fucked. So the Colonel takes back the 3 piece feed and bins it then refuses to offer the man any form of compensation.. So now the man has no 3 piece and is down about 14 bucks. (providing he got a large upgrade) Sure he man-handled that 3 piece and made a few wrong choices but why should that leave him without it?
When does the change in ownership happen? When does your car become the cops car because your a hoon?
Edit: OK, After speaking to a mate of mine I understand a little better.. they are taking away the tool in which you use to break the law. Like taking a gun off a armed robber or lab equipment off meth dealers.. Its an extreme measure that is taken to repeat offenders.. I just think its still fucked..

Thats true but money is too good it would cost them alot of money to do this.
If they made licences are fuck load more expensive it would work and there would be no need for speed cameras.. I say tax people for getting a licence not people who do 5km over the limit.

I wonder what happens if a bank has security over the car??
If I was an owner with not much in assets and an expensive car I'd let the bank wear the cost of this instead, and wait 7 years for my record to wiped clean before applying for another loan again. I guess it's better than paying off a car that no longer exists lol!

If all the people on here who are jumping up and down about this calling it a 'publicity' stunt, then be proactive and organise a rally at the venue about why is the car is being crushed when the sale of the vehicle could of been given to victims of crime etc. With all the media there, I am sure you can get some of their attention!

Edit:
Come to think of it, if there is question time for anyone, I might enquire as to why this vehicle wasn't sold as the fetching price at auction would be $35k+ (correct me if I'm wrong).
I also hope that the little turd that made the Ch7 report about the "underground car club" is present, and I'll give it my best efforts to park my car in such a way that the sticker is easily seen by everyone.

Instead, they should donate the cars (like the Galant) to a proper driver learning centre (if they could fathom the idea of actually providing driver education and training for our licensing system in their peanut sized brains) and crush the absolute shitbox deathtraps that blow copious amounts of smoke to actually make a difference. The car is still taken away - crushing it or not doesn't make a difference..
Seems it is "too hard" to do the logical thing...

I guess this has not yet been tested, but I'd love to see cops crush one, and then get sued by the finance company to recover the costs, and win. Would be classic. Rob Cockson would no doubt be forced to make the changes, or even better, resign.
