Are these sorts of cases treated as seperate cases?? (ie double the punishment)


POLICE have impounded two vehicles from one man overnight after catching him drink-driving without a licence in both vehicles.

Police involved in Operation Unite, a national crackdown on alcohol-fuelled behaviour, stopped a Ford Falcon in suburban Subiaco about 9pm last night.

Police say the 23-year-old, who was driving on a cancelled licence, was also carrying cannabis and a knuckle duster in the car.

The driver failed a breath test and was charged with being unlicensed, driving under the influence of alcohol, and possession of a prohibited drug and weapon.

The car was impounded for 28 days before the man was bailed around midnight.

But two hours later, police stopped the same driver - again in Subiaco. This time he was at the wheel of a Mitsubishi Lancer.

The driver again failed a breath test and was again charged with unlicensed driving. That car also was impounded.

The man will face Perth Magistrates Court on September 24.

I wonder what would happen if one of the cars wasn't his, and the owner of said car wanted their car back... I know that the new substitution laws mean that the drivers own car can be substituted for the car that has been originally impounded, but what if their car is already impounded?

Two separate cases will be heard, maybe both at the same time and going by what's been reported he would probably be charged with both offences, not necessarily "double" the punishment but he will definitely be charged on two separate counts.

The second charge may even have a more severe punishment seeing as though he had been charged earlier in the night and had known what he had done was wrong yet was caught doing it again later that same night.

Yes I know Captain Obvious but from what I could gather that's most probably what would happen but mind you this is only the opinion of a third year law student and not a fully qualified/competent lawyer.

Its not just that bloke, its Perth in general. Last night they had FWY north closed down to one lane for roadworks.. Probably two k's of 'merge left' 'two lanes closed' signs, flashing lights, cones etc, yet fuckwits still sat in all three lanes right up until they physically couldn't drive further. One clown actually ran over three cones to try and squeeze in front of some other guy in the next lane. I ended up leaning out my window and screaming at some silly bitch because they almost drove into me, after I let like 3 other people in front of me, she decided that I should let four people in. The gf had to stop me getting out and expressing myself more physically. /csb, but fuck. Very nearly lost my shit.

Isn't that what the another guy did earlier this year, and then lost his license for life? Do a burnout - get caught - get another car - do another burnout - get caught. All in the space of a couple hours??

Not sure, but there was that one dude who got busted for DD I think, then a couple of hours later for speeding after he overtook the same booze bus on the fwy & I think got hoon lawed.

That's why DD should mean automatic confiscation of car for 28 days AND a night in a cell. DD is far worse of a road hazard then giving it a bit of stick for 5 seconds.
