Anyone had any success getting a payout from a shire/council as a result of tyre damage from shitty roads? I'm sure I read something on here a while ago that people have been successful.

About 4 years ago I hit a pothole just out of Bunbury and dented two rims. I was paid out $1400.

some poeple had followed up following a buckled rim. council needed to have been notified of the issue and still dont nothing about it for them to be liable.
its a tyre. just replace it. shit happens.

dam wish i had followed mine up, 1400 would have got me 2 brand new rims. Had the same thing big pothole in a puddle in a slow point bent 2 rims.
I am still awaiting compensation for 3 tyres slashings

Is it true that if they have been notified AND it's 2 days after that when you hit it, then you can claim? Think I read that on one of these forums but could be over east laws.
If they don't know of it you can't claim.

rhett, i would put a claim in and see.
i dove past a council mower years ago, a rock/honky nut from the mower hit my car and dented the rear quarter, city of melville paid for it.

Just make sure your cars not lowerd to the ground and its legal. Heard they wont payout of mods are done

what? how is that in any way logical, there is still a pothole that caused it it has nothing to do with what mods are done to you car, the road is their responsibility. you dont just get dented rims from having a lowered car if the road is fine.
thats like saying you wont get compensation if you are fat...

Friend in QLD smashed the sump on his lowered E30 because roadworks hadnt warmed that they put a massive dip in the road. Sump dent fucked oil flow = fucked donk
3 months, but they paid out 7k.

Hit a pot hole avoiding a muppet who pulled out of the Shell servo on Berwick Street. RE001s. Paid $360 a corner back in the day, so I wanted that back as a minimum. Obviously the equivalent is cheaper now but that's not the point.
Lodged a claim with Town of Vic Park, they're going to send tech services out to fix the road and cheque will be sent when the claim is processed.

Good work, FYI I asked the ex council man at work (Been at council forever before here).
He said complain about the problem and then lodge the claim, so they would have had time to rectify but wouldn't have.

If the pothole was already patched once, then they are considered to have known about it already. Have a look and see if it's ever been filled in with fresh bitumen.

It was repaired by 5pm according to the Shell guy. They sent "tech services" out straight away by the looks.

u should have gone around the pot hole or just hit the doodle that pulled out
.. dif story if situation like the mower flicking a rock doing damage.
next thing ppl will try hold council liable for flat tyres from screws or nails left on the road cause the council didnt clean em up

Good job, I despise fraud but if you make a genuine claim the worst thing they can do is refuse it. Pity the muppet that pulled out in front of you won't receive the invoice for it.

I'll be trying my luck with getting Main Roads to cover my excess on the claim for a new bumper:
(busted a couple of moulded clips on the inside of the bumper, will no longer hold, pulled holes along the bottom of the bumper, minor gouging and scuffing on the left side of the bumper a few cm above the lip

*car isn't lowered, sits at 15cm above the ground
*view of sloping entrance is blocked by main roads fencing along Gt Eastern Hwy
If you sometimes use BP in Belmont along Gt Eastern Highway, avoid!

I drove up and down that very same driveway yesterday in my lowered 5 series (front lip 80mm to ground) did not scrape at all.

Here's a hint - the photo was taken later on from across the road. You don't get the luxury of that view when turning immediately into that drive on a 60km/h highway. Vision is blocked by fencing. If I saw it, I would have avoided it (despite not expecting any trouble in a car at stock height).
Butcher - I assume your car has stiffer springs or coilovers if the beemer is lowered? That alone would save you. It doesn't take much to compress my springs obviously :/

craig, that would be no different that tearing your mudflaps off reversing up a sloped kerb (hypothetically).. would there be as much damage if the lip wasnt there to begin with? The car is modded. It certainly wouldnt have happened to a standard wrx.. Not being cynical, just dont see an argument in it...

Well, it is a standard wrx... the suspension and ride height hasn't been changed. Have a look at the lip on the left side of the photo. The contact marks are at the same height as the bottom of the bumper, so yes damage (albeit less) would have been sustained if there was no lip.
I've pulled in at normal speed, unaware of the change in road conditions. I would have gone in slower or avoided it altogether had there been visual warning. There is an element of negligence/stupidity on main roads by obscuring the view of the drive. There's not much chance they will cough up, but they actually have a claim form on their website and I have nothing to lose giving it a go. I shared my csb in case there is a positive outcome that may be helpful to others in the future, and also to alert others of the steep entrance.

Isn't that whole strip of road currently being upgraded, and has a slower speed zone?
Generally when roads are being upgraded, driveways/curbs are also affected. So common sense would of prevailed here??

Not that I need to explain myself any further, but I wasn't travelling along Gt Eastern Hwy and the speed limit has not been reduced. The upgrade is being done well left of flowing traffic, hence why main roads has everything shielded by fencing. I was on the way home from work, on Resolution Drive. Normally I would turn into that entrance of BP but it was blocked off that afternoon (sometimes it's open, sometimes it's closed). I turned left at the lights, drove along Gt Eastern for all of about 30 metres, turned left into the drive and *bang*.
Anyway, don't you have some Bogan Commodore Wankers to go shake your fist at?

Obviously other drivers had issues with this temporary crossover as well. Long story short, Main Roads will reimburse me for a replacement front bumper, painting and lip upon receival of a paid receipt for the work. They asked that I send in two quotes for the work and have now agreed to pay for the damages after sighting those. So good news.
